X50 Pocatello Well No. 2 previously used under water rights 29-2401, 29-2499, 29-4221, 29-4223, 29-4224, 29-4225, 29-4226, 29-7106, 29-7322, 29-11339, 29-11348, 29-13558, 29-13559, 29-13560, 29-13561, 29-13562, 29-13637 and 29-13639 shall be abandoned in a manner which complies with Department well abandonment rules. Further, the right holder shall request that Well No. 2, located in L2(NWNE) Sec 1, T07S, R34E, be removed as an authorized point of diversion for these rights.
124 Place of use is within the service area of the City of Pocatello municipal water supply system as provided for under Idaho Law.
211 To the extent necessary for administration between points of diversion for ground water, and between points of diversion for ground water and hydraulically connected surface sources, ground water was first diverted under this right from Pocatello Well No. 1 located in T07S, R34E, S01, Lot 2 (NWNE) in the amount of 2.45 cfs, from Pocatello Well No. 2 located in T07S, R34E, S01, Lot 2 (NWNE) in the amount of 2.45 cfs and from Pocatello Well No. 3 located in T07S, R34E, S01, SWNE in the amount of 4.23 cfs. Well No. 1 was replaced by Well No. 5 located in T06S, R34E, S35, NWNE and Well No. 2 was replaced by Well No. 2R located in T07S, R34E, S1, SWNE.
214 Prior to the diversion and use of water under Transfer approval 87529, the right holder shall install and maintain acceptable measuring device(s) at the authorized point(s) of diversion in accordance with Department specifications, or shall obtain an approved variance from the Department to determine the amount of water diverted from power records or to maintain an existing measuring device.
213 Upon specific notification of the Department, the right holder shall install and maintain data loggers to record water usage information at the authorized point(s) of diversion in accordance with Department specifications.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
