The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 29.

Rights 29-13399 and 29-13401 when combined shall not exceed a total diversion rate of 0.88 cfs and the irrigation of 44 acres.
Rights 29-187, 29-188, 29-191(Part), 29-193, 29-11678, 29-11681(Part), 29-13399 & 29-13401 when combined shall not exceed a total diversion rate of 6.55 cfs and the irrigation of 327.4 acres.
Prior to diversion of water under Transfer 71892, the right holder shall place the portion of water rights 29-191 and 29-11681 equivalent to 44.0 acres and appurtenant to the place of use authorized for Rights 29-13399 and 29-13401 under this transfer in the water bank operated by the Idaho Water Resource Board.
To prevent injury through approval of Transfer 71892 to prior rights appropriating water from East Bob Smith Creek, diversion and use of this right shall be subordinate to Rights 29-12361 and 29-12982.

This right is limited to the irrigation of 36 acres within the place of use described above in a single irrigation season.
R63
This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.

The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
