Claims 27-3C, 27-37F, 27-11939, 27-3G, 27-10296, 27-10341, 27-10344, 27-10505, 27-10756, and 27-11940 have been recommended in the Snake River Basin Adjudication with places of use that partially or completely overlap the place of use for this right. If these claims are decreed as recommended, they shall not exceed a total diversion rate of 7.66 cfs and the irrigation of 288.2 acres when combined with right 27-7577. |

The portion of Right 27-7577 used for conveyance losses is 1.63 cfs and 328 af. The conveyance loss portion of this right shall not be transferred to another beneficial use. Furthermore, if the right holder changes the method of conveyance and reduces conveyance losses, this right shall be diminished by the amount no longer needed for conveyance losses. |

Diversion of water under this right shall be used to supply share holders of the East Idaho, Corbett Slough, and Blackfoot Irrigation canal companies diverting water from the Miner Ditch. Miner Ditch users will allow their surface water shares to continue down the Snake River as mitigation to offset the use of groundwater under this right. |

This right when combined with all other rights shall provide no more than 4.0 afa per acre at the field headgate for irrigation of the lands above. |

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer. |

Prior to the diversion and use of water under Transfer approval 74459, the right holder shall install and maintain acceptable measuring device(s), including data logger(s), at the authorized point(s) of diversion and in accordance with Department specifications, or shall obtain an approved variance from the Department to determine the amount of water diverted from power records or to maintain an existing measuring device. |
| R02 |
A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion. |

This right does not grant any right-of-way or easement across the land of another. |
