Recreation use is for 2 ponds that are not to exceed 6.0 af.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 01.
R43
The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.
The right holder shall not divert water under this right when senior Rainey Creek rights downstream are not being filled unless: a.) the same amount of water being diverted from Rainey Creek under this right is being returned to Rainey Creek, or b.) the right holder has compensated Rainey Creek for losses caused by the evaporation and/or seepage of water diverted under this right.
The right holder must rent water from the Palisades Storage Rental Pool to mitigate the evaporation losses occurring under this right.

The use of water under this right shall not give rise to any claim against the holder of a senior water right based upon the theories of forfeiture, abandonment, adverse possession, waiver, equitable estoppel, estoppel by laches or customary preference.
