Rights 23-48B and 23-98B when combined shall not exceed a total of 15 irrigated acres in a single irrigation season.

Prior to diversion of water under this approval, the right holder shall provide a means of measurement and lockable controlling works for all authorized points of diversion. The means of measurement and controlling works must be suitable for control of the diversions and acceptable to the watermaster.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 01.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.

This right is limited to the irrigation of 11.2 acres within the place of use described above in a single irrigation season.

The total instantaneous diversion of water from all points of diversion under Rights 23-48B and 23-98B shall not exceed 0.45 cfs.

Prior to diversion of water under this right, the right holder shall provide a means acceptable to the department to measure the amount of water entering the pond and the amount of water released from the pond.
Irrigation use from the pond is limited to those times water is available from Rainey Creek under this right and priority and by the quantity of water actually diverted to the pond for irrigation use
Rights 23-48B & 23-98B authorize the diversion of an annual total of 2.5 acre-feet identified as Recreation Storage to be used for supplemental filling of the natural pond and for the replacement of losses caused by evaporation from the pond.
Diversion of water for storage purposes under Rights 23-48B &23-98B to supplement the natural pond is limited to times when the total surface area of the pond does not exceed 0.3 acres.

The prior irrigation use of the portions of Rights 23-48B and 23-98B changed to storage uses shall be abandoned and the right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
