Code Condtions
214 Prior to the diversion and use of water under Transfer approval 79866, the right holder shall install and maintain acceptable measuring device(s) at the authorized point(s) of diversion in accordance with Department specifications.
This water right is limited to four points of diversion: three existing wells located in the NWNE of Section 16, T07N, R42E and a fourth well to be constructed in the SESE of Section 11 or the SWSW of Section 12, T07N, R42E.
Upon completion of the new ground water well authorized under Transfter 79866, the right holder shall notify the department of the exact location of the new well and request that the undeveloped point of diversion be removed from the water right.
The point of diversion located in either Section 11 or 12, T07N, R42E, authorized under Transfer 79866, shall be limited to a diversion rate of 6.41 cfs and an annual diversion volume of 1609 acre-feet.
R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the place of use.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code and applicable Well Construction Rules of the Department.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
