X35 Rights 22-195 and 22-196 when combined shall not exceed the irrigation of 10,615 acres.
X53 No more water may be diverted from Canyon Creek and the Teton River under this right than is actually available and could have been diverted by the Canal Company at its original point of diversion in T5N R43E S6 Lot 4, as demonstrated by the record of the required measuring devices.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 01.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversions.
Prior to the beginning of each irrigation season, the right holder must provide the watermaster a summary of the portions of water rights 22-195 and 22-196 to be assigned to each of the authorized points of diversion for the irrigation season.
The right holder shall maintain a permanent measuring device in Canyon Creek at the point of diversion located in T5N R43E S6 Lot 4. The right holder shall also maintain a permanent measuring device in Canyon Creek Canal, and at each point of diversion.
This right is subject to all prior and intervening water rights which would otherwise be injured by the approval of transfer 1985.
F01 Water is delivered through Canyon Creek Canal, P Stevens Pump, G Crapo Pump, R B Ricks Pump, V Schwendiman Pump, Canyon Creek Lateral Pumps, and an unnamed pump.
135 The boundary encompassing the place of use for this water right is described with a digital boundary as defined by I.C. Section 42-202B(2) and authorized pursuant to I.C. Section 42-1411(2)(h). The data comprising the digital boundary are incorporated herein by reference and are stored on a CD-ROM disk issued in duplicate originals on file with the SRBA District Court and the Idaho Department of Water Resources. A map depicting the place of use is attached hereto to illustrate the place of use described by the digital boundary.
129 Place of use is within the area served by Canyon Creek Canal Company.
Place of use does not include Federal lands unless authorized in writing by the United States Bureau of Reclamation.
004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
