Code Condtions
The right holder is authorized to develop one new well site under Transfer 85536. Within one year of the approval of Transfer 85536, the right holder shall notify the Department of the location of the well site developed and ask the Department to remove any unused points of diversion from this water right.
180 A map generally depicting the service area for this water right at the time of this approval is attached to this document for illustrative purposes.
128 Place of use is within the area served by the public water supply system of Teton Springs Golf and Casting Club. The place of use is generally located within Sections 13, 14, 23, and 24, Township 3N, Range 45E.
212 Prior to diversion and use of water under Transfer approval 85536, the right holder shall install and maintain acceptable measuring device(s) at the authorized point(s) of diversion, in accordance with Department specifications.
213 Upon specific notification of the Department, the right holder shall install and maintain data loggers to record water usage information at the authorized point(s) of diversion in accordance with Department specifications.
075 Irrigation of large projects such as parks, golf courses, or sports activities fields is not authorized under this right.
106 Prior to the diversion and use of water under this approval, the right holder shall comply with applicable water quality monitoring and/or permitting requirements administered by the Department of Environmental Quality or the Department of Agriculture.
J02 The point of diversion for this right located in Section 24 is within Homestead Entry Survey No. 386.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code and applicable Well Construction Rules of the Department.
004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
