X27 This right is limited to the irrigation of 1,144.6 acres within the authorized place of use in a single irrigation season.
Water rights 21-12358 and 21-13258 are appurtenant to the same 278.2 acres in Sections 12, 13 and 14, T08N, R41E.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District Nos. 01 and 100.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
The right holder shall maintain two separate measuring devices at the point of diversion located in the SENE, Section 13, T08N, R41E: one to measure the quantity of water injected into Fall River and one to measure the quantity of water diverted for direct irrigation.
065 The right holder shall make full beneficial use of all surface water rights available to the right holder for irrigation of the lands authorized to be irrigated under this right. The right holder shall limit the diversion of ground water under this right to those times when the surface water supply is not available or the surface water supply is not reasonably sufficient to irrigate the place of use authorized under this right.
R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the place of use.
This right is subject to all prior existing water rights and no demand on upstream prior rights or existing exchanges can be made or interference with prior downstream rights allowed even if the exchange well is pumping water into Fall River.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
