The right holder shall maintain ownership and control of 25 acre feet (AF) of storage water in the Fremont-Madison Irrigation District in order to make the water available to the Water District 01 Rental Pool for mitigation of injury to other water rights that may be determined.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
The well constructed as the point of diversion for this right shall be cased and grouted such that all cascading water above the water table will be sealed out of the well, so that commingling of the upper and lower aquifers is prevented.

After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to determine the amount of water diverted from power records and shall annually report the information to the Department.

The use of water under this right shall not give rise to any claim against the holder of a senior water right based upon the theories of forfeiture, abandonment, adverse possession, waiver, equitable estoppel, estoppel by laches or customary preference.
