Once water is diverted on the new lands, water cannot be used on the previously irrigated lands during the remainder of the irrigation season. |

A second crop cannot be gown and/or harvested from the new lands during the same growing season that a crop has been grown on the old land. "Crop" in this case also includes irrigated pasture. |

If the 4,128 acres listed in the place of use are split into multiple ownerships, the water right shall be appurtenant to the 504 acres listed in the last notice, if any, submitted to the department unless otherwise provided for in the instrument of conveyance. |

The right holder must install, as part of his diversion works, a continuous recording totalizing device that records the total volume of water diverted from the Snake River during the given irrigation season. On or before January 1 of the following year, the applicant shall submit a copy of the volume record to the department. |

Violation of any conditions of Transfer 3531 is cause for the Director to cancel or modify the transfer. The land owner shall be entitled, however, to designate 504 acres to which the water right shall become appurtenant upon cancellation. |

The use of water for irrigation under this right may begin as early as March 15 and may continue to as late as November 15, provided other elements of the right are not exceeded. The use of water before April 1 and after October 31 under this remark is subordinate to all water rights having no subordinated early or late irrigation use and a priority date earlier than the date a partial decree is entered for this right. |

After specific notification by the Department, the department must be notified in writing if a change occurs in the location of irrigated land, prior to diverting the water and must be provided a map showing the location of acres to be irrigated within 40 acre tracts. |

After specific notification by the Department, the right holder shall install a suitable measuring device to record the total volume diverted or shall enter into an agreement with the Department to determine the volume of water diverted from power records and shall annually report the volume diverted to the Department. |
