R65
This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.5 afa per acre at the field headgate for irrigation of the place of use.
X61
The period of use for the irrigation described in this approval may be extended to a beginning date of 3/1 provided that beneficial use of the water can be shown and other elements of the right are not exceeded. The use of water before 3/15 is subordinate to all water rights having no subordinated early irrigation use and a priority date earlier than 10/31/2011.
01M
After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.
X53
Diversion of Jump Creek is limited to those times water is available for diversion under this right and priority from the Snake River at the original point of diversion.
Upstream water rights on Jump Creek existing at the time of this transfer approval (Transfer 81936) shall not be curtailed to deliver water to this right for diversion at the Jump Creek point of diversion. Provided this right is otherwise in priority and other conditions of the transfer approval are met, this condition is not intended to limit the ability to use water at the Jump Creek point of diversion made available when junior, upstream Jump Creek rights are curtailed to deliver rights on the Snake River.
004
This right does not grant any right-of-way or easement across the land of another.
This water right is a split from former license 02-2318. As a result, access to the decreed point of diversion and delivery system for this water right is located on property other than that to which this water right is appurtenant. The decreed elements for this water right do not consttitute a judicial determination of the validity of any right to access the point of diversion and/or conveyance system located on property other than to which this water right is decreed appurtenant. The judicial determination of the right of access to the point of diversion and conveyance system was decided separately in Wilkerson v. Snake River R.V. Resort, et. al., Third Judicial District, Owyhee County (Case No. CV-06-05541). Any right of access to the point of diversion and the conveyance system located on property other than to which this water right is decreed appurtenant is subject to the final judgement entered in that proceeding.
T07
The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08
Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19
Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
