Plaintiff (Thayne O. Daniels) is entitled to 100% of available flow from 5/21 through 8/15 for irrigation purposes. He is also entitled to 50% of available flow from 8/15 through 5/5 for irrigation purposes. Place of use is a total of 51 acres. Additional place of use is a total of 28 acres located in SWNE, S36, T14S, R35E, B.M., Oneida County, Idaho, with a priority date of August 1, 1988, being the date of expansion of the described water right to this additional acreage. During the period the water is evenly diveided between Plantiff Thayne O. Daniels & Defendant Tom Palmer from August 15 through May 5 annually as above described, if the available water is inadequate to supply the needs of both parties, at the request of either party the available water shall be rotated on a weekly basis with the non-requesting party to have full use of the water the first week of the rotation. During the times of exclusive use by Plantiff Thayne O. Daniels or Defendant Tom Palmer of available flow for irrigation purposes as above-described, such use shall be subject to the stock water rights of the other party described above.
