X35 Rights 13-7996 and 13-7998 when combined shall not exceed a total diversion rate of 1.00 cfs.
Transfer (Exchange) 81756 authorizes the right holder to divert water under this right from an unnamed spring located in the NESWSW of Section 28, T10S, R40E, which is tributary to the Bear River, to fill and maintain two small ponds used for fish propagation.
R05 Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 11.
R02 A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion.
220 The two ponds established by the storage of water under this right shall not exceed a total capacity of 2.8 acre-feet or a combined surface area of 0.5 acres.
This right is subordinate to any rights established on the unnamed spring water source pursuant to Public Water Reserve 107.
004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
