Code Condtions
071 The domestic use authorized under this right shall not exceed 13,000 gallons per day per home.
106 Prior to the diversion and use of water under this approval, the right holder shall comply with applicable water quality permitting requirements administered by the Department of Environmental Quality or the Department of Agriculture.
F06 Water right 13-7499 is also diverted through the point of diversion described above.
To mitigate for any impacts caused by diverting ground water under this right, the right holder agrees that the seven homes added to the Midway Water system under this right will no longer use existing ground water wells to supply water to the homes for culinary or domestic irrigation purposes. Water rights 13-7746 and 13-7755 will no longer be used for culinary or domestic irrigation purposes. Existing ground water wells may continue to be used for stockwater purposes provided the use is authorized by an existing water right or qualifies under a statutory exemption.
X35 Rights 13-7499 and 13-7763 when combined shall not be used to deliver water to more than 19 homes.
