R04 Use of water under this water right will be regulated by the watermaster of State Water District No. &DISTRICT.
Groundwater diverted under this right is injected into the Bear River in exchange for authorization to divert water from an unnamed spring, tributary to Fivemile Creek, at the point of rediversion to irrigate the place of use. Water shall not be diverted from the spring unless an equal amount of groundwater is being injected into the Bear River. Measuring devices and lockable controlling works of a type acceptable to the Department shall be permanently installed and maintained at the point of diversion from groundwater and at the point of rediversion from the unnamed spring. Failure of the right holder to comply with the conditions of this license is cause for the Director to revoke the license pursuant to Section 42-350, Idaho Code. Diversion and use of water under this right shall be reduced or curtailed when necessary to prevent injury to holders of prior rights diverted from Fivemile Creek downstream from the point of rediversion.
R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
