R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
T07 The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.
020 Use of water under this right may be affected by an agreement between the protestant and the right holder.
Two points of diversion are located within NENW, S20, T09S, R40E. The period of use for the irrigation described in this approval may be extended to a beginning date of 4/1 and an ending date of 10/31 provided that beneficial use of the water can be shown and other elements of the right are not exceeded. The use of water before 4/15 and after 10/15 is subordinate to all water rights having no subordinated early or late irrigation use and a priority date earlier than the date of this approval. Right 13-02259 is limited to the irrigation of 158 acres within the place of use described above in a single irrigation season. Right 13-07165 is limited to the irrigation of 156 acres within the place of use described above in a single irrigation season. Right 13-07198B is limited to the irrigation of 42 acres within the place of use described above in a single irrigation season. Right 13-07198C is limited to the irrigation of 110 acres within the place of use described above in a single irrigation season. Right 13-07261 is limited to the irrigation of 153 acres within the place of use described above in a single irrigation season. Rights 13-02259 and 13-07198C when combined shall not exceed a total diversion rate of 3.76 cfs, a total annual maximum diversion volume of 924.0 af at the field headgate, and the irrigation of 264 acres. Rights 13-07165, 13-07261 and 13-07198B when combined shall not exceed a total diversion rate of 5.12 cfs, a total annual maximum diversion volume of 1081.5 af at the field headgate, and the irrigation of 309 acres. The total instantaneous diversion of water from all points of diversion under Transfer 5545 shall not exceed 8.88 cfs, nor total combined annual volume of 2005.5 af, nor the irrigation of 573 acres. This approval does not authorize the construction of any new well or the deepening or enlargement of any existing well. Surface water shall not be commingled with groundwater unless the groundwater and surface water diversions are measured separately as approved by the Department.
T18 Prior to diversion of water under this approval, the right holder shall provide a means of measurement and lockable controlling works for all authorized points of diversion. The means of measurement and controlling works must be suitable for control of the diversions and acceptable to the watermaster.
R04 Use of water under this water right will be regulated by the watermaster of State Water District No. &DISTRICT.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
