When submitting an incremental statement of completion or a proof of beneficial use statement for this permit, the permit holder shall also submit a Beneficial Use Field Report prepared by a certified water right examiner and shall include a description of the permit holder's current service area. The report must clearly confirm and establish the extent of the beneficial use of water, including the maximum instantaneous rate of flow, established in connection with the permit during the reporting interval for an incremental statement of completion, or the planning horizon for final proof of beneficial use. The report shall be on the form or forms specified by the director and shall provide the information specified in Idaho Code § 42-217 and the department's Beneficial Use Examination Rules (IDAPA 37.03.02) for confirming beneficial use and such other information as may be required by the director. An incremental statement of completion shall be deemed incomplete and returned to the permit holder if the incremental statement of completion is not accompanied by this report unless the permit holder is not asserting any additional increment of beneficial use during the reporting interval. The final proof of beneficial use statement shall be deemed incomplete and returned to the permit holder if the final proof of beneficial use statement is not accompanied by this report.

When notified by the Department, the right holder shall install and maintain a measuring device of a type acceptable to the Department as part of the diverting works. |

When notified by the Department, the right holder shall record the quantity of water diverted and annually report diversions of water and/or other pertinent hydrologic and system information as required by Idaho Code § 42-701, and/or the management plan for the Rathdrum Prairie Ground Water Management Area. |

This right authorizes the diversion of ground water within the Rathdrum Prairie Ground Water Management Area (RPGWMA). Use of water under this right shall be subject to the provisions of the RPGWMA management plan approved by the director, including its conservation goals. |

The right holder shall not provide water diverted under this right for the irrigation of land having appurtenant surface water rights as a primary source of irrigation water except when the surface water rights are not available for use. This condition applies to all land with appurtenant surface water rights, including land converted from irrigated agricultural use to other land uses but still requiring water to irrigate lawns and landscaping. |
