The Director retains jurisdiction to require the right holder to provide purchased or leased natural flow or stored water to offset depletion of Lower Snake River flows if needed for salmon migration purposes. The amount of water required to be released into the Snake River or a tributary, if needed for this purpose, will be determined by the Director based upon the reduction in flow caused by the use of water pursuant to this permit. |

Rights 65-5633, 65-8850 and 65-11324 provide replacement water for the evaporative losses associated with the storage described by this right. |

Water diverted under this right for aesthetic and recreation uses shall be returned to the South Fork Payette River. |

This right shall be junior and subordinate to future upstream water rights authorizing the diversion and use of water from the Payette River and its tributaries, including ground water, for consumptive uses, except that this right shall not be subordinate to future water rights for similar wildlife, recreation and/or aesthetic uses. |

Project construction shall commence within one year from the date of permit issuance and shall proceed diligently to completion unless it can be shown to the satisfaction of the Director of the Department of Water Resources that delays were due to circumstances over which the permit holder had no control. |

During many years, the full measure of use authorized by this water right cannot be sustained for the entire year. The developer and/or owner of the development served by this water right shall disclose to future lot purchasers at the time of the sale of the lots in the subdivision that full flow in the aesthetic streams and full storage in the ponds may not be possible because of senior priority minimum stream flow water rights in the South Fork of the Payette River or by climatic conditions. |
