Prior to the diversion and use of water under this approval, the right holder shall comply with applicable water quality permitting requirements administered by the Department of Environmental Quality or the Department of Agriculture.

The Director retains jurisdiction to require a bypass flow on Sand Hollow Creek for maintenance of fish, wildlife, riparian and aquatic habitat.

When notified by the Department, the right holder shall install and maintain measuring devices of types acceptable to the Department at the point of diversion and at the point of return to the source stream.
Until a water district is established for Sand Hollow Creek and upon notification by the Department that water is not available to fully satisfy senior rights, the right holder shall (a) curtail all diversion of water, (b) curtail enough diversion of water to satisfy senior rights, or (c) mitigate impacts to senior rights. A mitigation plan must be approved by the Department prior to any mitigation activity.
This right shall be junior and subordinate to future water rights authorizing the diversion and use of water from Sand Hollow Creek and its tributaries, including ground water, for consumptive uses, except that this right shall not be subordinate to future water rights for similar wildlife, recreation and/or aesthetic uses.
Wildlife storage use is for habitat improvement during the non-irrigation season.
Wildlife use is for flow thru and return flow water associated with wildlife storage under this right during the non-irrigation season.
Water diverted under this right shall be returned to Sand Hollow Creek as the creek leaves the west boundary of the place of use after allowance for initial storage fill and for evaporative, seepage and conveyance-related losses. This water right shall remain subject to senior water rights despite the return of water to Sand Hollow Creek.

This right does not grant any right-of-way or easement across the land of another.

The Director retains jurisdiction to require the right holder to provide purchased or leased natural flow or stored water to offset depletion of Lower Snake River flows if needed for salmon migration purposes. The amount of water required to be released into the Snake River or a tributary, if needed for this purpose, will be determined by the Director based upon the reduction in flow caused by the use of water pursuant to this permit.

The single pond established by storage of water under this right shall not exceed a total capacity of 30 acre-feet or a total surface area of 15 acres.
