Code Condtions
220 The reservoir established by the storage of water under this right and right 23-7146 shall not exceed a total capacity of 80 acre-feet.
During any year that American Falls Reservoir does not completely fill, the holder of this right must purchase forty (40) acre-feet or water from the Snake River rental pool to replace water stored and used from the proposed reservoir. During each year, the permit holder shall not use water from the reservoir until he has determined, through the Snake River Watermaster, that American Falls Reservoir has physically filled or the permit holder has rented the rental pool water herein required.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 01.
R02 A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion.
This right in combination with right 23-7146 only authorizes a one time annual fill of the reservoir.
18B The impoundment of water under this right is contingent upon the issuance of a certificate of approval per the dam safety provisions of Idaho Code and subsequent written authorization by the dam safety program administered by the Department.
R63 This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the place of use.
